Terms & Privacy
This page is the contract and the privacy notice for JunkShelf. The Terms cover ordering, refunds, and photos. The Privacy Policy covers how we handle personal information, including uploads. By submitting the order form or paying an invoice, you agree to both.
Last updated October 2, 2026. JunkShelf operates from California, United States.
Terms of Service
1. Agreement
JunkShelf is a small studio in California, United States. We make custom 3D-printed figurines from photos you send us. These Terms are a contract between you and JunkShelf.
The Privacy Policy on this same page explains how we handle personal information, including photos.
2. Who may order
You must be at least 18 years old to request a quote or place an order. The website is not directed at children, and we do not knowingly collect information from anyone under 13.
You may order a figurine of a person under 18 (for example, your child) if you are their parent or legal guardian, or you have permission from someone who is. See Photos and permission below.
3. Quotes and orders
Submitting the order form is a request for a free quote. It is not a purchase. We may accept, decline, or ask for different photos or details.
A binding order starts when you accept a quote and pay. Until then you can walk away at no cost. Quotes may expire; we will say so when we send them. Price, size, finish, and timeline are confirmed in the quote, not by the options you pick on the form.
4. Photos and permission
You must own the photos you upload, or have the right to send them to us to make a figurine. If a photo shows another person, you confirm they have agreed, or you have another lawful right to use their image for this order.
If anyone in a photo is under 18, you confirm you are their parent or legal guardian, or you have permission from someone who is. Do not send sexual, nude, or exploitative images of anyone under 18. We will refuse that content and may report it where the law requires.
A figurine is an artistic interpretation, not a perfect copy. Likeness depends on the photos you send. Clear, well-lit photos from more than one angle help. We are not responsible for results caused by blurry, cropped, or misleading references.
5. Custom, made-to-order goods
Every figurine is made to your specifications from your photos. It is a personalized product, not a stock item. Once we start modeling, printing, or finishing after you approve a quote, the piece is being made for you and cannot be resold as new.
If you live in the European Economic Area, the United Kingdom, or another place with a cooling-off or withdrawal right for online purchases, you agree that right does not apply once we begin producing a figurine made to your specifications. You still have the protections in Cancellations and refunds for defects, damage, and items that do not match what we agreed.
6. Payment
We take payment after you accept a quote, usually through a PayPal or Stripe payment link. Those companies process the payment. We do not store full card numbers.
Prices in a quote are in the currency we state there. Taxes, duties, or import fees charged by your country are your responsibility unless we say otherwise in writing. An order is not in production until payment clears.
7. Cancellations and refunds
Before you pay. You can cancel a quote request at any time. There is nothing to refund.
After you pay, before we start. Email us. If we have not started modeling, printing, or finishing, we will refund what you paid for that order, minus any non-refundable processor fees we cannot recover.
After production has started. Because the figurine is made only for you, we do not offer refunds or returns for change of mind, a gift that was not a surprise, or a likeness you later decide you dislike when the piece matches the photos and quote we agreed.
If something is wrong. Contact us within 14 days of delivery, with photos, if the figurine arrives damaged, is missing, or does not match the size, color, stand, or design we confirmed. We will repair, remake, or refund, as we think is fair. That is how we handle quality problems, including for customers outside the United States.
8. Shipping
We ship to addresses we can reasonably reach. Delivery estimates in a quote are estimates, not guarantees. We will send tracking when the carrier provides it.
Risk of loss passes when the carrier accepts the package, except where your local consumer law says otherwise. If a shipment is lost or damaged in transit, tell us promptly so we can help with a claim or a remake.
9. Intellectual property
- You keep the rights you already have in the photos you send. You give us a limited license to use them to quote, make, ship, and support your order, and to store them as described in the Privacy Policy.
- We do not claim ownership of your original photos. We do not put those uploads in our public gallery, ads, or social posts unless you later agree in writing. We will not use images of identifiable minors in marketing without separate written permission from a parent or guardian.
- We may photograph the finished figurine (the object we made) for our own records or portfolio. That is a photo of our work, not a republication of your original file.
- Our website, logo, process, and 3D production files stay ours. You own the physical figurine you buy. You may not copy or sell our digital files.
10. Acceptable use
You agree not to:
- Upload content that is illegal, or that you do not have the right to send.
- Upload sexual or exploitative images of anyone under 18.
- Misuse the site (for example, attacking it, scraping it abusively, or submitting malware).
- Order a figurine meant to harass, defame, or impersonate someone in a harmful way.
We may refuse an order or remove content that breaks these rules.
11. Disclaimers and liability
The site is provided as is. We work carefully, but we do not promise uninterrupted access, or that a figurine will be an exact replica of a photograph.
To the fullest extent allowed by law, JunkShelf is not liable for indirect, incidental, special, or consequential damages, or for lost profits. Our total liability for a given order is limited to the amount you paid us for that order.
Some places do not allow these limits. If you are a consumer in the EEA, the UK, Canada, or another jurisdiction that grants mandatory rights, those rights still apply. These Terms do not take away rights you cannot waive.
12. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. Except where the law of your country requires otherwise (including some consumer claims in the EEA, UK, or Canada), disputes will be resolved in the state or federal courts located in California, and you and we consent to those courts.
Please email us first and give us a reasonable chance to fix the problem. If a court finds part of these Terms unenforceable, the rest still applies.
13. Changes to these Terms
We may update these Terms. The date at the top of this page is the latest version. Changes apply to new quotes and orders after we post them. For an order already paid, the Terms in effect when you paid still apply, unless the law requires otherwise.
Privacy Policy
1. Who we are
JunkShelf is the business responsible for this website and for the personal information we collect. We operate from California, United States. For EU/UK data-protection law we are the controller of that information.
The Terms of Service above cover ordering, refunds, and photos. This section covers privacy.
2. What we collect
Depending on how you use the site, we may collect:
- Identifiers and contact details you give us: name, email, phone, Instagram username.
- Order details: size, color, stand, notes, and the quote or invoice that follows.
- Photos and file names you upload so we can model the figurine. Photos of people are personal information.
- Payment status and limited transaction data from PayPal or Stripe. We do not store full card numbers.
- Technical data the site needs to run: IP address, browser type, device, pages viewed, and approximate location derived from IP.
- Messages you send us by email or Instagram.
We do not require an account. We do not intentionally collect government ID numbers, precise GPS, health data, or payment card PAN data on this site.
3. How we use it
We use personal information to:
- Review your request and send a quote.
- Make, finish, and ship the figurine if you order.
- Take payment, prevent fraud, and keep records we need for tax and law.
- Reply to you and handle refunds, remakes, or complaints.
- Keep the site secure and understand, in aggregate, how people use it.
If you are in the EU/UK, we rely on: performing a contract (or steps before a contract) for quotes and orders; legitimate interests for security and basic analytics that help us run a small studio without profiling you for ads; and legal obligation for records we must keep. You may object to processing based on legitimate interests by emailing us.
4. Photos and children
Photos are used to sculpt and check your figurine. We do not use uploads to train public AI models, run facial recognition, or sell image libraries.
You must have the right to send the photos, including permission from people shown in them. If a subject is under 18, you must be their parent or guardian, or have permission from someone who is.
We do not put your original uploads in the public gallery, ads, or social media unless you agree separately in writing. We will not use images of identifiable minors in marketing without written permission from a parent or guardian. We may photograph the finished physical figurine for our portfolio; that is a picture of the object we made.
6. Selling and sharing
For every customer, including throughout the United States, we do not sell your personal information and we do not share it for cross-context behavioral advertising. We do not use or disclose sensitive personal information to infer characteristics about you.
Because we do not sell or share in that sense, we do not offer a “Do Not Sell or Share” cookie opt-out for advertising. If that ever changes, we will update this policy and provide a way to opt out. California’s CCPA/CPRA is the law that defines those “sell” and “share” terms; we apply the same practice to all U.S. customers.
We also do not disclose personal information to other companies so they can market their own products to you (including California “Shine the Light”).
7. How long we keep it
- Source photos: we keep them while we quote, make, and, if needed, remake your figurine. We aim to delete or irreversibly de-identify original uploads about 90 days after we finish the order (or after we decline or you withdraw a quote we never produced), unless a dispute, remake, or legal duty requires a longer hold.
- Order and payment records: kept as long as tax, accounting, and consumer-law rules require.
- Messages: kept as long as needed to support you and the studio.
- Analytics: kept according to our analytics provider’s settings, in aggregated or short-lived form where we can.
9. Your rights
To exercise your privacy rights, email hq.junkshelf@gmail.com, preferably with the subject “Privacy request.” Where permitted by law, we may request information reasonably necessary to verify your identity or an authorized agent’s authority. We will not discriminate against you for exercising your privacy rights.
Rights are subject to applicable legal conditions and exceptions. For example, we may need to retain certain transaction records to meet tax or accounting obligations. If we cannot fulfill your request, we will explain why, as required by law.
United States. We offer all U.S. customers the ability to request access to, correction of, or deletion of their personal information, even where state law does not require us to do so. We aim to respond to these requests within 45 days and will meet any applicable legal deadline.
Depending on your state and whether its privacy law applies, you may have additional rights, including obtaining a portable copy of your information or opting out of its sale, targeted advertising, or certain types of profiling. Where you have a right to appeal our decision, you may submit an appeal to the email address above.
California residents (CCPA, as amended by the CPRA). Where the CCPA applies, you may request information about the categories and specific pieces of personal information collected about you, its sources, the purposes for collecting, selling, or sharing it, and the categories of recipients. You may also request deletion or correction, opt out of sale or sharing, and limit certain uses and disclosures of sensitive personal information, where applicable. You may use an authorized agent to submit a request.
We respond to requests to know, delete, or correct within 45 calendar days, unless a legally permitted extension applies. If an extension is necessary, we will notify you within the initial period and explain why. Other requests are handled within their applicable legal deadlines.
EU/EEA and United Kingdom. Where the EU GDPR or UK GDPR applies, you may request access, correction, deletion, or restriction of processing. In qualifying circumstances, you may receive personal data you provided in a portable format. You may object to processing based on legitimate interests and to processing for direct marketing.
Where we rely on consent, you may withdraw it at any time without affecting the lawfulness of processing before withdrawal. You may also lodge a complaint with your competent data protection authority. We respond without undue delay, normally within one month, subject to extensions or adjustments permitted by applicable law.
Canada. Under PIPEDA or applicable provincial privacy laws, you may request access to and correction of your personal information, subject to legal exceptions. Where PIPEDA applies, we respond to access requests within 30 calendar days unless a legally permitted extension applies. We will provide any required notice of an extension. Other requests are handled within the deadlines required by applicable law.
Other countries. You may contact us to exercise rights available under your local law. We will also consider reasonable requests for access, correction, or deletion in good faith where no specific legal right applies.
10. International transfers
We are based in the United States. If you write to us from the EU, UK, Canada, or elsewhere, your information is processed in the United States and anywhere our providers operate. Those providers typically use contractual protections (such as standard contractual clauses) for transfers from the EEA/UK. By using the site or sending a quote request, you understand that US law may apply to servers and records here.
11. Security
We use HTTPS, reputable hosts, and access limited to people who need it to make your figurine. No method of transmission or storage is perfectly secure. Please do not upload photos you would not trust a small studio to hold for the time it takes to make the piece.
12. Children’s privacy
You must be 18 to submit the order form. We do not knowingly collect personal information from children under 13, and this site is not directed at them. If you believe a child under 13 submitted information, email us and we will delete it.
Photos of children sent by an adult as the subject of a figurine are handled as described in Photos and children. We keep those files only as long as needed for the order and do not use them for marketing without a parent or guardian’s written permission.
13. Changes to this Privacy Policy
We may update this policy. The date at the top of this page is the current version. If we make a material change, we will post the new policy here. Continued use of the site after an update means the new policy applies to information we collect from then on.
